This privacy policy is intended to inform you about how the company GROUPE FOREST HILL, a public limited company (SA) with a board of directors, registered with the Paris Trade and Companies Register under number 309 990 349, with a share capital of €521,820, and headquartered at 4-6 rue Louis Armand, 75015 Paris, as the data controller, collects your personal data (hereinafter referred to as “Personal Data”) via the websites https://www.forest-hill.fr/ and https://reservation.forest-hill.fr/ (the “Websites”).
GROUPE FOREST HILL is highly committed to respecting your privacy and the confidentiality of your Personal Data. It undertakes to process your Personal Data in compliance with the applicable laws and regulations, including Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data (the “GDPR”), and French Law No. 78-17 of January 6, 1978, relating to data processing, data files, and individual freedoms, as amended (together, the “Applicable Regulation”).
GROUPE FOREST HILL reserves the right to modify this Privacy Policy at any time, in whole or in part. Any modifications will be communicated to you through appropriate means.
1. WHAT PERSONAL DATA IS PROCESSED?
The Personal Data collected by GROUPE FOREST HILL via the Websites includes:
- Data relating to your identity;
- Contact data (e.g., email address, phone number, etc.);
- Via the subdomain “Espace Pro,” which is exclusively accessible to representatives of the employee committees of our partner companies, data related to your membership in a partner company of GROUPE FOREST HILL;
- Data related to your subscription;
- Data related to your activity reservations or trial sessions.
The Personal Data processed is collected directly from you or is derived from your subscription contract.
In certain cases, we may also collect your Personal Data from:
- Our partner Anybuddy (name, surname, reservation data) if you made a reservation at one of our Forest Hill clubs via the Anybuddy app;
- Our partner Sport-Booking, the e-commerce reseller of our Forest Hill subscriptions, when you purchase a subscription on the website https://www.sport-booking.com;
- The employee committee of your employer (name, surname, email address, and the company you are associated with) to enable you to benefit from discounts and coupons.
2. WHY ARE YOUR PERSONAL DATA PROCESSED?
The processing of Personal Data by GROUPE FOREST HILL via the Websites serves the following purposes:
- To create an account for you via the website https://reservation.forest-hill.fr/ to enable you to book racquet sports courts at Forest Hill clubs. The legal basis for the processing is the necessity for the performance of a contract to which you are a party or to take steps at your request prior to entering into a contract;
- To respond to your information requests related to GROUPE FOREST HILL or its affiliates, available subscriptions, racquet sports courts, and their booking methods, or any other request related to our activities, based on GROUPE FOREST HILL’s legitimate interest in responding to inquiries;
- If you have already booked a court, or if you have given your consent, to send you information about our activities and news related to GROUPE FOREST HILL or its affiliates, based on GROUPE FOREST HILL’s legitimate interest in growing and retaining its customer base;
- To allow you to benefit from discounts and vouchers available to you due to our partnership with your employee committee, based on GROUPE FOREST HILL’s legitimate interest in providing you with preferential terms negotiated with your employee committee.
For the aforementioned purposes, we may require certain mandatory data without which we cannot perform the service. These data are marked with an asterisk on the collection forms.
3. WHO ARE THE RECIPIENTS OF YOUR PERSONAL DATA?
The Personal Data is processed, to the extent necessary for their responsibilities, by:
- The marketing, logistics, legal, and accounting departments of GROUPE FOREST HILL;
- External service providers, including IT service providers, who are responsible for implementing personal data processing or assisting with consultancy and support for GROUPE FOREST HILL. In this case, GROUPE FOREST HILL ensures that its contracts with subcontractors comply with legal and regulatory provisions;
- Legal auxiliaries and officials in the course of their mission of legal assistance and representation in the event of a dispute;
- Judicial authorities;
- Any individual or legal entity authorized by an enforceable court decision;
- Affiliated companies and business partners of GROUPE FOREST HILL, if you have expressly agreed.
4. HOW LONG ARE YOUR PERSONAL DATA STORED?
Your Personal Data is retained for no longer than necessary for the purposes for which it is processed, including for the duration of your account’s activity or for periods proportionate to commercial prospecting purposes.
We inform you that, in order to fulfill our legal obligations or to defend ourselves in the event of a dispute, we may retain Personal Data strictly necessary for intermediate archiving for these legal retention or limitation periods.
5. YOUR RIGHTS
Under the Applicable Regulation, you can exercise the following rights at any time:
- Right of access: You can obtain information regarding the nature, origin, and use of the Personal Data that concerns you. If your Personal Data has been shared with third parties, you may also request information about the identity or categories of recipients;
- Right to rectification: You may request that inaccurate or incomplete Personal Data be corrected or completed;
- Right to erasure: You may request the deletion of your Personal Data, particularly if the data is no longer necessary for the purposes for which it was processed. GROUPE FOREST HILL will proceed with the erasure of your Personal Data as soon as possible, unless there are regulatory exceptions;
- Right to restrict processing: You may request that your Personal Data be temporarily made inaccessible in order to restrict its future processing in the cases provided by the Applicable Regulation;
- Right to object: You may object to certain processing of your Personal Data for reasons related to your particular situation, unless there are legitimate and overriding grounds for processing, or for the establishment, exercise, or defense of legal claims. You may also object to the processing of your Personal Data for commercial prospecting purposes at any time and without reason;
- Right to withdraw consent: If the processing is based on your consent, you may withdraw it at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before the withdrawal;
- Right to data portability: In applicable cases, you can request to receive your Personal Data in a structured, commonly used, and machine-readable format;
- Right to provide instructions regarding the fate of your Personal Data after death.
